1. About these terms
These are the terms on which you may use Tumble.
Tumble is operated by Rhythm Limited, trading as Tumble and Just Tumble, a company registered in England and Wales with company number 15186358, whose registered office is at 24 St. Stephens Gardens, London, W2 5QX.
You can contact us at [email protected].
These terms apply when you:
- create or use a Tumble account;
- browse activities or provider listings on Tumble;
- book an activity through Tumble;
- use Tumble to manage a booking;
- use other Tumble features made available to you from time to time.
Other documents may also apply, including our:
- Cancellation Policy;
- Privacy Policy;
- Child Safety Policy;
- Health and Medical Information Notice;
- Photography and Media Consent;
- Participation Notice; and
- any specific terms displayed before you make a particular booking.
Where a provider's own terms apply to an activity, we will make those terms available to you before you book where reasonably practicable.
Nothing in these terms affects any legal rights you have as a consumer.
---
2. What Tumble does
Tumble brings children's classes, camps, activities, events and other experiences together in one place.
Some activities can be booked and paid for through Tumble. Others are listed on Tumble so that you can discover them, but the booking takes place directly with the provider.
Tumble does not itself run the classes, camps or activities listed on the platform unless we expressly say otherwise.
The provider is responsible for delivering the activity, including deciding:
- what the activity involves;
- who can attend;
- the age or ability requirements;
- where and when it takes place;
- who supervises children;
- its safeguarding arrangements;
- its cancellation and attendance policies; and
- the standard and manner in which the activity is delivered.
Tumble is responsible for the Tumble services that we provide to you, including the operation of your account, our platform and the services we expressly agree to provide to you.
---
3. Two types of listing
3.1 Bookable through Tumble
Where an activity is marked as bookable through Tumble, you can make the booking through Tumble.
The activity is supplied by the provider.
Before you pay, we will show you the key information available to us about the booking, including the provider, price, activity details and applicable cancellation terms.
3.2 Book with the provider
Some activities on Tumble are provided for information and discovery only.
Where an activity says “Book with provider”, Tumble is not taking the booking or payment for that activity.
Instead, you will be directed to the provider or its booking system and your contract for that activity will be directly with the provider.
The provider is responsible for its own booking system, prices, availability, terms and cancellation arrangements.
We aim to keep these listings reasonably up to date and may periodically check information published by providers or their booking systems, but we cannot guarantee that every listing is accurate or current at every moment.
You should check the provider's current details before booking.
---
4. The contracts between you, Tumble and the provider
There may be more than one contractual relationship involved in using Tumble.
Your contract with Tumble
Your contract with Tumble covers the Tumble services, including your account, access to the platform, booking functionality and other services that Tumble provides to you.
Your contract with the provider
When you book an activity, the contract for the provision of that activity is between you and the provider, unless the booking page expressly says otherwise.
The provider is responsible for providing the activity in accordance with the information and terms presented to you.
Tumble may act as the provider's booking or commercial agent in relation to bookings made through Tumble. The precise legal and payment arrangements between Tumble and the provider are governed by our agreement with that provider.
Nothing in these terms makes Tumble the provider of an activity merely because the activity is booked through Tumble.
---
5. Prices and payments
We do not add a booking fee, service charge or card surcharge to the provider's advertised price for an activity.
Unless we expressly say otherwise, the price shown to you at checkout is the amount you pay for the activity.
Any applicable discount, promotional offer or provider-specific charge will be shown before you complete your booking.
Where payment is made through Tumble, payment is processed using the payment arrangements made available by Tumble and its payment service providers.
Card payments are processed by our payment provider. Tumble does not receive or store your full card number.
Payment on behalf of providers
Where Tumble is authorised by a provider to receive or process payment for an activity, Tumble may receive or process that payment on the provider's behalf.
The effect of payment being made through Tumble, including when your payment obligation to the provider is discharged, depends on the payment and agency arrangements applicable to that booking.
We will not ask you to pay the same booking twice merely because Tumble has processed the payment.
---
6. Your account
You must be at least 18 years old to create a Tumble family account.
You are responsible for making sure that information you provide to us is accurate and kept up to date.
This is particularly important for information that a provider may need to keep a child safe, including:
- date of birth or age;
- allergies;
- relevant medical information;
- emergency contact details; and
- people authorised to collect the child.
You must tell us if information that could affect a child's safety changes.
Household access
One Tumble account may be used by a household.
You may invite another parent, carer or other person to use the account with permissions you choose.
You are responsible for people you authorise to use your account and for activity carried out through permissions you have given them.
Each person should use their own login and must keep their login credentials secure.
Tell us promptly if you believe that your account has been accessed without permission.
Guest bookings
Where guest booking is available, you may make a booking without first choosing a password.
We may create or use an account associated with the booking so that we can hold the booking and the information needed to administer it.
You may subsequently claim or activate that account using the instructions we send to you.
Club or organisation accounts
If a club, school, employer, members' organisation or other organisation provides you with access to a Tumble-powered service, different account terms may apply to that service.
Where an account is controlled by that organisation, your relationship with that organisation is governed by its own terms.
Tumble access will only be added to or enabled for you in accordance with the choices and permissions made available to you.
---
7. Children's information
Tumble is designed to make it easier for families to provide information that activity providers need.
Where you choose to provide information about a child, you confirm that you are authorised to provide that information for the purposes for which it is requested.
You should only provide information that is accurate and relevant.
Where you book with a provider, Tumble may share relevant information about the child with that provider so that the provider can administer the booking and provide the activity safely.
We do not give every provider access to every child's information simply because that child is on Tumble.
Information is shared according to the purposes explained in our Privacy Policy and Health and Medical Information Notice.
---
8. Booking an activity
A booking is not complete merely because an activity has been placed in a basket or selected.
Your booking is confirmed when Tumble or the relevant provider sends you a booking confirmation or otherwise tells you that the booking has been accepted.
If an activity has limited capacity, a place is not guaranteed until the booking has been confirmed.
If a booking cannot be completed because availability changes before confirmation, we will tell you and, where you have already been charged, arrange the applicable refund.
The information shown before you confirm your booking forms part of the information on which you are making your booking.
You should check the details carefully, including:
- child;
- activity;
- date and time;
- location;
- provider;
- price;
- number of sessions;
- age or eligibility requirements; and
- cancellation terms.
---
9. Activities starting after the term has begun
Where a provider allows you to join a term after it has started, the price may be calculated by reference to the sessions remaining in the term.
The price and what you receive will be shown before you confirm the booking.
---
0. Cancellations and refunds
Our Cancellation Policy explains the cancellation and refund rules that apply to bookings made through Tumble.
The provider's cancellation policy may also apply to the activity.
Before you book, we will show you the cancellation terms that apply to that booking where reasonably practicable.
Tumble's accidental-booking policy
In addition to any rights you have under applicable law or the provider's cancellation policy, Tumble currently offers an accidental-booking refund where:
- you cancel within 5 days of making the booking; and
- the activity is at least 14 days away when you cancel.
This is an additional Tumble policy and does not replace or reduce any legal right you may have to cancel or obtain a refund.
The detailed conditions and exclusions are set out in the Cancellation Policy.
---
11. Statutory cancellation rights
Some consumer contracts have a statutory right to cancel within a cooling-off period.
Those rights do not apply to every activity.
For example, the law contains an exception for certain leisure activities where the contract provides for a specific date or period of performance.
Where a statutory cancellation right applies, nothing in these terms or the Cancellation Policy removes or limits it.
Where a statutory cancellation right does not apply, you may still have cancellation rights under the provider's terms, our Cancellation Policy or other applicable law.
---
12. If a provider cancels or changes an activity
A provider may sometimes need to cancel, postpone or change an activity.
If this happens, Tumble may communicate the change to you and may assist with any refund or alternative arrangement that is available.
The provider remains responsible for the activity and for the provider's obligations to you.
Where Tumble has received the payment for the booking and is able to process the refund on the provider's behalf, we may do so through Tumble.
If a provider does not resolve a legitimate refund that it owes you, contact Tumble and we will investigate and, where appropriate, help resolve the matter.
---
13. Memberships and recurring payments
Some providers offer memberships or recurring arrangements through Tumble.
Unless the booking or membership page expressly says otherwise, a membership is a contract between you and the provider.
Before you join, we will show you the information we have been given about the membership, including, where applicable:
- price;
- payment frequency;
- minimum term;
- renewal arrangements;
- notice period;
- cancellation arrangements; and
- any other material conditions.
Where you save a payment card for recurring payments, you authorise the applicable payment arrangement to charge that card for the recurring payment you have agreed to.
We will not use a saved card for an unrelated purpose without your agreement or another lawful basis.
You may remove a saved card subject to any outstanding payment obligations and any requirements of the relevant payment arrangement.
Cancelling a membership
Where Tumble provides a self-service cancellation facility, you may use it to request or complete cancellation as described on the membership page.
The date on which your membership ends depends on the membership terms you agreed to, including any applicable notice period or minimum term.
Before you confirm cancellation, we will tell you the expected end date and any further payment that may become due.
Nothing in this section limits any statutory right to cancel or end a subscription or recurring contract.
---
14. Saved payment cards
If you choose to save a payment card, you authorise us and/or our payment provider to use that card for the purpose for which you saved it.
For example, this may include:
- a recurring membership payment;
- an agreed automatic top-up; or
- another payment arrangement clearly identified to you.
You can remove a saved card through your account where that functionality is available.
Removing a saved card does not cancel payments that you have already authorised or other amounts that are already due.
---
15. Tumble balance, credits and gift cards
Where the Tumble balance feature is available, your account may display amounts that can be used towards eligible bookings.
These amounts may include, depending on the feature involved:
- amounts you have added;
- refunds;
- promotional credits;
- gift-card value; or
- other credits provided by Tumble or a provider.
The precise legal and payment status of the balance depends on how the relevant balance feature is structured and who issues or holds the underlying funds.
Your balance:
- is not a bank account;
- does not pay interest;
- cannot be transferred between Tumble accounts unless we expressly allow it; and
- may only be used for the purposes and with the providers permitted by the applicable balance terms.
We will explain any restrictions applying to a particular credit, gift card or balance before you acquire or redeem it where reasonably practicable.
Refunds to balance
Where a refund is credited to your Tumble balance, we will tell you that this is how the refund will be provided.
Where applicable law requires a refund to be made by another method, those legal rights take precedence.
Gift cards
Any gift card terms displayed when a gift card is purchased or redeemed form part of the gift card arrangement.
Gift cards do not expire unless the applicable gift-card terms clearly say otherwise.
Unused gift cards may be subject to the refund rules stated at the time of purchase.
Once redeemed, a gift card may be subject to the applicable balance and refund rules.
---
16. Session packs and make-up sessions
Some providers offer prepaid session packs, credits or make-up passes.
These are supplied or honoured by the provider.
The applicable terms, including any expiry date, restrictions on use or transfer and cancellation rules, will be shown before purchase where reasonably practicable.
---
17. Provider safety information
Tumble requires providers using the platform to provide information about matters such as safeguarding, insurance, DBS checks and relevant training where applicable.
Where Tumble holds information or records relating to those matters, we may display or use them in accordance with our Child Safety Policy.
Tumble does not independently verify every declaration, qualification, DBS check, insurance policy or safeguarding arrangement provided by a provider.
Tumble is not the employer of a provider or its staff merely because the provider uses Tumble.
You should make your own enquiries where you need further information about a provider's suitability for your child.
Nothing in this section affects any responsibility Tumble has for information that Tumble itself provides to you or for services Tumble itself supplies.
---
18. Child safety and safeguarding
The safety of children is extremely important to us.
Our Child Safety Policy explains:
- what information providers are required to provide;
- what Tumble checks or records;
- what Tumble does when information expires or concerns are raised;
- how safeguarding concerns can be reported; and
- when Tumble may suspend a provider or listing.
If you believe that a child is at immediate risk, contact the emergency services or appropriate safeguarding authority as appropriate rather than relying on Tumble.
You should also tell us about serious safety concerns involving an activity listed or booked through Tumble.
---
19. Reviews
Where Tumble publishes reviews, ratings or review information about providers or activities, we aim to provide a genuine and useful picture of families' experiences.
Unless we expressly say otherwise:
- only families who have attended or otherwise genuinely experienced the relevant activity may submit a review;
- reviews must be based on the reviewer's genuine experience;
- incentivised reviews must be identified where required;
- reviews must not identify a child or disclose another family's private information;
- reviews must not be abusive, threatening, discriminatory, unlawful or irrelevant; and
- providers may be given an opportunity to respond.
We may remove or decline to publish reviews where reasonably necessary to enforce these rules, protect children or other users, comply with law, or prevent misleading or prohibited review content.
We do not buy or commission fake reviews.
We do not remove a genuine review merely because it is negative or because a provider disagrees with it.
We may use reasonable and proportionate checks to establish whether a review appears genuine.
---
20. Information about activities
Activity descriptions, availability, prices, age ranges, photographs and other information are supplied by providers or obtained from provider or other public sources unless we expressly say otherwise.
We aim to present this information accurately and clearly.
Providers are responsible for ensuring that information they provide to Tumble is accurate and up to date.
If you identify information that appears wrong or unsafe, please tell us.
---
21. Using Tumble fairly
You must use Tumble lawfully and fairly.
You must not:
- use Tumble for an unlawful purpose;
- impersonate another person;
- create fake accounts or bookings;
- submit fake or misleading reviews;
- interfere with the operation or security of Tumble;
- attempt to access another person's account or information;
- upload information that you do not have the right to upload;
- upload information that identifies another child or family without an appropriate lawful basis or permission;
- use Tumble to harass, threaten, defraud or mislead another person;
- copy or extract Tumble content in bulk;
- operate automated scraping or crawling systems against Tumble, except for ordinary search-engine indexing;
- use Tumble content to build a competing directory or service; or
- use Tumble content to train an AI or machine-learning system without our prior written permission.
We may restrict or suspend access where necessary to protect Tumble, our users, providers or children.
---
22. Our intellectual property
Tumble and its licensors own or control the intellectual property rights in Tumble, including our software, branding, design, databases and original content, except for content supplied by providers or users.
You may use Tumble for your personal, non-commercial use in accordance with these terms.
You must not reproduce, commercially exploit or systematically extract Tumble's content without our permission.
This does not prevent you from using information about your own bookings or other information that you are otherwise legally entitled to use.
---
23. Privacy
Our Privacy Policy explains how we collect, use, store and share personal information.
Because Tumble is designed to manage information about children, our privacy documentation includes additional information about children's data and, where relevant, health and medical information.
You should read the Privacy Policy and Health and Medical Information Notice before using Tumble to provide information about a child.
---
24. Tumble's responsibility to you
We will provide the Tumble services with reasonable care and skill.
We are responsible for losses that are reasonably foreseeable as a result of our breach of these terms or our failure to use reasonable care and skill.
We are not responsible for:
- the way an independent provider runs its activity;
- an activity not being delivered by a provider in accordance with its own obligations;
- a provider's own website or booking system where you book directly with that provider;
- information supplied by a provider that later becomes inaccurate, where Tumble could not reasonably have known that it was inaccurate;
- events genuinely outside our reasonable control; or
- losses that are not a reasonably foreseeable consequence of our breach.
However, nothing in these terms excludes or limits liability where doing so would be unlawful.
In particular, nothing in these terms excludes or limits liability for:
- death or personal injury caused by negligence;
- fraud or fraudulent misrepresentation;
- breach of any legal right that cannot lawfully be excluded or limited; or
- any other liability that the law does not allow us to exclude or limit.
Nothing in these terms limits your statutory consumer rights.
---
25. If an activity goes wrong
If an activity is not provided as described, is cancelled, or you have a concern about how it was delivered, you should normally raise the issue with the provider first because the provider is responsible for delivering the activity.
You can also contact Tumble.
We may:
- contact the provider;
- help you understand the provider's terms;
- investigate information available to us;
- help communicate between you and the provider; or
- where appropriate, assist with a refund.
Nothing in this section prevents you from exercising a legal right directly against the provider or Tumble where you have one.
---
26. Complaints
If you have a complaint about Tumble, contact:
We aim to acknowledge complaints within 2 working days and provide a substantive response within 14 days, where reasonably practicable.
If your complaint concerns an activity supplied by a provider, we may ask you to contact the provider as well because the provider is responsible for the activity.
If your complaint concerns personal data, you may also have the right to complain to the Information Commissioner's Office.
---
27. Accessibility
We want Tumble to be accessible and usable by as many families as possible.
If you have difficulty using Tumble or completing a booking, contact us and we will consider reasonable ways to help you access the service or complete the booking.
---
28. Suspending or closing accounts
You may stop using Tumble at any time.
You may ask us to close your account by contacting us.
We may suspend or close an account where we reasonably believe that:
- these terms have been seriously or repeatedly breached;
- the account has been used fraudulently;
- the account creates a security or safeguarding risk;
- we are required to do so by law; or
- continued access would put Tumble, another user or a child at risk.
Where reasonably practicable, we will tell you why we have suspended or closed an account and give you an opportunity to respond.
We may act without prior notice where necessary for safety, fraud prevention, security or legal reasons.
Closing an account does not automatically cancel bookings, memberships or other contractual obligations that you have with a provider.
We will deal with existing bookings, credits and balances in accordance with the applicable terms and any rights you have under law.
---
29. Changes to Tumble
Tumble is developing and may change over time.
We may make changes to:
- the platform;
- features;
- functionality;
- technical requirements; and
- these terms.
If we make an important change to these terms, we will give you reasonable notice before it takes effect where required.
Changes to these terms will not retrospectively alter the contractual terms of a booking you have already made, except where the change is required by law or is otherwise permitted by the contract.
If a change materially affects an ongoing recurring arrangement, we will give you any notice or cancellation rights required by law and the applicable contract.
---
30. Events outside our control
We are not responsible for delay or failure to perform our obligations where this is caused by an event genuinely outside our reasonable control.
This may include events such as major technical failures, widespread telecommunications outages, natural disasters, serious public emergencies or other events that could not reasonably have been prevented.
This does not affect your legal rights where the law requires a different result.
---
31. If part of these terms is invalid
If a court or other competent authority decides that any part of these terms is unlawful or unenforceable, the remaining provisions will continue to apply.
If we do not enforce a right immediately, that does not mean that we have permanently waived it.
---
32. Third-party rights
Unless these terms expressly say otherwise, only you and Tumble may enforce these terms.
The provider's rights and obligations are governed by its separate agreement with Tumble and by the contract between the provider and you where applicable.
---
33. Governing law and courts
These terms are governed by the law of England and Wales.
If you live in Scotland or Northern Ireland, you may also have the right to bring proceedings in the courts of the part of the UK in which you live, and you retain any mandatory protections given to you by the law applicable to you.
